Terms and Conditions

Users, Data Access and Subscriptions

Every user of dnswl.org must read and understand the terms and conditions for the use of dnswl.org data.

A “user” is an organisation or an individual who operates hardware and/or software for filtering spam, for aggregating e-mail reputation data or for reselling such services to end-users, using dnswl.org data. Typically, e-mail service providers, anti-spam appliance vendors and similar organisations are considered to be “users”. A “subscription” is a paid access for a single user to dnswl.org data.

Every user with more than 100’000 queries per day on the public nameserver infrastructure and every commercial vendor of dnswl.org data must register with dnswl.org and purchase a subscription. The subscription can be obtained directly from the dnswl.org project or through a licensed reseller. It is the responsibility of the user to ensure that he is properly registered and has a valid subscription, even if access to the public nameservers is not explicitly blocked for that particular user.

Additionally, users with less than 100’000 queries per day on the public nameservers may also register and obtain a subscription. Access to dnswl.org data through public DNS is free of charge within reasonable limits; no registration or subscription is required.

A subscription allows the user to download a local copy of the dnswl.org data once per hour at an agreed minute from specified IP addresses in multiple formats for it’s own, internal use or for reselling as defined in the subscription. Without prior written approval, redistribution of the dnswl.org data is not allowed. It is also not allowed to offer dnswl.org data through public DNS.

A subscription allows the user to access dnswl.org data through designated nameservers without needing to download the data. Setup instructions for both types of access are made available to subscribers.

For subscribers with a direct subscription from dnswl.org, subscriptions start and end at the dates specified upon payment of the associated fee. Subscriptions are not automatically renewed. A renewal notice is sent to the e-mail address(es) registered for a user before a subscription runs out.

For subscribers with a subscription through a licensed reseller, the terms and conditions of that reseller apply.

Fees for a subscription may be waived or lowered for users who contribute substantially back to dnswl.org, or for other reasons at the discretion of the dnswl.org project. Fees for subscriptions may be adjusted at any time, affecting new subscriptions from the date and time of the change only.

If the original justification for a reduced rate or a free subscription is not valid any more, dnswl.org may change the subscription to an appropriate paid subscription. If the user does not agree to the terms of the new subscription, the subscription will be cancelled.

Subscriptions are fully independent to any listings in the database of dnswl.org, i.e. a subscription will not influence the DNSWL record of the subscriber. dnswl.org reserves full editorial independence over the whitelisting data criteria and decisions.

The fine print

dnswl.org data is protected by copyright and other applicable law. Any use of the data other than as authorized under the terms and conditions above or by copyright law is prohibited.

Access to the dnswl.org public nameservers may be blocked for all users doing more than 100’000 queries per day at any time. dnswl.org is under no obligation to contact the owners of IP addresses seen doing more than the specified limit before blocking such access.

Representations, Warranties and Disclaimer

UNLESS OTHERWISE MUTUALLY AGREED TO BY THE PARTIES IN WRITING, DNSWL.ORG DATA IS OFFERED AS-IS AND NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE DATA, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTIBILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, OR THE ABSENCE OF LATENT OR OTHER DEFECTS, ACCURACY, OR THE PRESENCE OF ABSENCE OF ERRORS, WHETHER OR NOT DISCOVERABLE ARE MADE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SUCH EXCLUSION MAY NOT APPLY TO YOU.

Limitation on Liability

EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, IN NO EVENT WILL DNSWL.ORG BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF THESE TERMS AND CONDITIONS OR THE USE OF THE DATA, EVEN IF DNSWL.ORG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Termination and Changes

dnswl.org reserves the right to change these terms and conditions at any time for any reason, observing any termination and change clauses in previous terms and conditions.

Miscellaneous

If any provision of these terms and conditions are invalid or unenforceable under applicable law, it shall not affect the validity or enforceability of the remainder of the terms and conditions, and without further action by the parties to this agreement, such provision shall be reformed to the minimum extent necessary to make such provision valid and enforceable.

Jurisdiction

Place of jurisdiction for these terms and conditions and the relationship between the users and the dnswl.org project is Zürich, Switzerland.

Closing statements

These terms and conditions take effect on Mai 25, 2017.

The previous terms and conditions (License 1.0) are not applicable to dnswl.org data and services from the date these new terms and conditions take effect. Data obtained prior to this date remain licenced under the previous license, or as agreed to in writing between you and dnswl.org.
